49. John⁶ Humphrey (James⁵, James⁴, Chambers³, Thomas², John¹). John was born circa 1818. He married Pencey Penny? Odum on 12 Mar 1838 at Robeson County, NC. John died circa 1847. His body was interred.
In the early 1840's John sold much of his land he had inherited. He sold 517 acres at one time and small acreages at other times. His Will was written in May, 1847 and recorded in the Aug., 1847, Term of Court. The slave, John, that he mentions in his Will was the boy slave left to him by his grandfather, James, Sr., in his Will made in 1837. John Humphrey was to get the slave at his grandmother's death. Court records show that John, the slave, about 23 years old, was sold in Nov., 1847 after John Humphrey died. Will of John Humphrey - Made 13 May, 1847. In the name of God, Amen. I, John Humphrey of the County of Robeson and State of North Carolina, being of sound and disposing mind and memory, do make and ordain this my last Will and Testament in manner and form following, to-wit - It is my will and desire that Olif Tiner take my son, William Humphrey, and raise him and send him to school and as a compensation for which I do give and bequeath to her one milch cow and one bed and furniture also the liberty and right of cultivating the plantation in which I now live and priviledges of the houses and appurtenances thereto belonging for a term of ten years, then her claim to it on any part of it is to expire and the land so occupied by her to be the exclusive property of my son, William Humphrey. Except the 50 acres on which William Tiner now lives. It is my will and desire that he, William Tiner, shall have that 50 acres at the price of two dollars per acre, if he thinks proper to take it. If not, it is to remain the exclusive property of my son, William Humphrey. It is further my will and desire that my Executor take into possession all my personal and perishable property and dispose of it in the manner and for following, to-wit - Dispose of my two negroes John and Tamer at private sale - to the best advantage to some good citizen of the County on a credit of for 12 months and take for the purchase money notes with approved.
